1. Identification and contact details of the Data Controller

GMS Management Solutions, SL, a company with head office at Plaza Pablo Ruiz Picasso, 1, Torre Picasso, 28020, Madrid, Spain, with tax identification number (CIF) B-83509307, and telephone number +34 91 1830800 (hereinafter, "MS" or the "Company") is responsible for the processing of all personal data you provide through our registration form. This policy provides information on how the Company will use personal data about its candidates.

The purpose of this Privacy Policy is also to provide information about your rights under the General Data Protection Regulations ("GDPR"). If you have any questions regarding the processing of your personal data, please contact MS at the following address: privacy@managementsolutions.com.

2. Information required and need to keep it updated

All fields marked with an asterisk (*) in the forms provided are mandatory, so that failure to complete any of them could prevent us from being able to provide the requested services.

The information you provide must be truthful, and you may not use aliases or any other means to hide your identity, except in those cases where the form expressly requests you to create a username, nickname or alias. 

It is essential that you keep reference numbers, passwords and access codes that you create or are provided with at all times. You will be solely responsible for the use, whether authorized or not, of your personal account, and in this sense you undertake to make diligent use of said information, not to make it available to third parties, and to communicate its loss or theft.

It is strictly forbidden to include personal data that are considered to be especially sensitive, such as data on health, union membership, race or religious beliefs.

In order for the information provided to always be up-to-date and not contain errors, you must inform MS of any changes and amendments to your personal data as soon as they take place, by sending an email to privacy@managementsolutions.com. You can also update your personal data through your private area on the Web.

By clicking on the "I accept" button included in the aforementioned forms, you declare that the information and the data you have provided in them are accurate and truthful.

3. General information: description of the information contained in the privacy policy

In this privacy policy you will find a table identifying each of the different data processing categories performed by the Company.
This table will provide you with information about:

  • The purposes of processing your personal data, i.e. the reason why MS processes your personal data.
     
  • The legal basis enabling MS to process your data for each of the stated purposes
     
  • The possibility of sharing your data with third parties, as well as the reason for doing so. Your personal data will be shared with all companies in the MS Group so that you may be included in the Group’s different selection processes. Also, your personal data may be accessed by those commissioned with the task of processing the data for which the Company is responsible, i.e. service providers who may need to access your personal data in order to perform their duties. As a general rule, service providers having access to your personal data operate in the information systems and IT industries. The table below shows other industries in which companies providing services for MS may need to access your personal data.

    We inform you that you may request more detailed information regarding the recipients of your personal data by sending an email to privacy@managementsolutions.com, indicating the specific data processing category for which you would like information on the recipients of your personal data.
  • The existence of potential international data transfers.
     
  • The length of time that the data you provide to us with will be held. For this purpose we inform you that we will keep your personal data for up to five years from receipt of your academic data, or for a longer period if you have so authorized us. Also, please be informed that we will keep your data to deal with any judicial, administrative or tax-related claims, for the length of time permitted by the applicable legislation. 

 

4. Detailed information on data processing carried out by MS

Managing the personnel selection process for the MS Group companies as well as the relationship with candidates
Legal basis
Consent granted by yourself be included in the selection processes and candidate databases of MS Group companies after you have provided us with your academic details or have applied for a specific job.
Recipients
Your personal data will be transferred to all companies in the MS Group so that you can be included in the different selection processes carried out by the Group, based on MS’s legitimate interest due to the fact that the recruitment tool is used for personnel selection across the Group. International data transfers

International transfers of your personal data may be made in order for MS Group companies to contact you, based on the Group’s legitimate interest to process your data for internal administrative purposes. You can find a list of these companies in the following link.

MS has formalized the corresponding standard contractual clauses with all Group companies in order to regularize international data transfers.

Retention period
Up to five years from receipt of your academic data.

 

Data processign purpose

Sending MS business communications via any means. Your data may also be used to invite you to corporate events.

Legal basis
Consent granted by yourself to be kept  informed of the Company's news and to invite you to events.
Recipients

Your personal data will not be transferred for this data processing category, except where necessary for your attendance at events. Service providers that could access your data are event management companies.

International data transfers

International data transfers of your personal data will not take place for this type of processing.

Retention period
Five years from your last interaction with MS.

 

5. Exercising your rights

We inform you that you can exercise the following rights:

  1. right of access to your personal data in order for you to know which data are being processed and the processing operations they are being used for.
  2. right to rectify any personal data that might be inaccurate.
  3. right to delete your personal data, whenever possible.
  4. right to request limitations on the processing of your personal data when the data processing accuracy, lawfulness or need is doubtful, in which case we shall be able to keep the data for the purpose of dealing with  or defending any potential claims.
  5. right to oppose the processing of your personal data, when the legal basis that enables us to process the data is a legitimate interest as shown in the table above. MS will stop processing your data unless it has an overriding legitimate interest, or does so in order to formulate, file, or defend claims.
  6. right to the portability of your data, when the legal basis that enables us to process the data is the existence of a contractual relationship or your consent as shown in the table above.
  7. right to revoke your consent.

You may exercise your rights free of charge at any time by sending an email to privacy@managementsolutions.com indicating the right you wish to exercise together with your identification details.

We would also like to inform you that you have the right to file a claim with the Spanish Agency for Data Protection if you believe that there has been a breach of the General Data Protection Regulation with respect to the processing of your personal data.
